| 1) |
For the purpose of these Terms & Conditions 'the Hirer' is defined as the persons or group or company renting the item or items from 'the Company'. ‘The Company” is defined as Melbourne
Toy Hire Co. |
| 2) |
All hire items are to be paid on delivery (or optionally prepaid with Internet orders) via cheque, cash, credit card or Eftpos for the rental period specified. A refundable bond may be requested when paying
by cheque or cash. |
| 3) |
The Hirer must complete a “hire agreement form” at the time of delivery. This form will indicate the hire period, including the start and finish dates, acceptance of instruction for the safe use
of the hire equipment and acceptance that you have read and agreed to all of the stated toy hire terms and conditions of the Company. |
| 4) |
The Hirer will only use the item or items hired for their intended use and only in accordance with instruction provided. |
| 5) |
The Hirer or their nominated carer is responsible to ensure that the items hired are suitable for the age and skills of the children who will use them. The Company shall not be liable for any consequential
customer loss, whether this arises from breach of duty to contract, or in any other way. The Company cannot accept any liability as a result of a failure to comply with specific instructions; under no circumstances will the Company
be held liable for any injury caused by or arising from items supplied. The Hirer or their nominated carer must ensure that any or all children using any equipment supplied by the Company are supervised at all times. |
| 6) |
The items supplied for hire by the Company will remain the exclusive property of the Company and the Hirer will not lend, sell, underlet, any items supplied for hire. The Hirer is not to remove the items from
the delivery address unless prior written approval is obtained from the Company. |
| 7) |
It is the Hirer’s responsibility to examine the supplied items prior to use to determine fitness and state of repair. The Hirer accepts responsibility to return the items in the same state of repair and
cleanliness as when delivered. The Hirer shall be responsible for any indemnity against loss or damage. |
| 8) |
In the event of a loss or theft of the items supplied the Hirer must provide the following:
| a) |
a police report in the case of a theft; |
| b) |
a signed statement in the case of a loss. |

| 9) |
A pre-arranged date will be agreed between the Hirer and the Company for the pick-up of the hired items. If for any reason you are unable to meet this arranged obligation please notify the Company prior to
the arranged date. The Company reserves the right to charge a late penalty fee. |
| 10) |
The Company reserves the right to utilise the services of debt collection agencies should any payment owing by the Hirer be outstanding and/or any of the following situations occur:
| a) |
Any cheque is dishonoured; |
| b) |
Any credit card transaction is declined; |
| c) |
The Hirer will also be liable for any costs incurred by the Company in recovering monies owing, which may also be recovered by the debt collection agency at the time of recovery of the initial amount owing. |
